Non-Disclosure Agreement (NDA) - Hostium

This Non-Disclosure Agreement ("Agreement") is entered into by and between Hostium ("Company", "we", "us", or "our") and the user ("Recipient", "you", or "your") of our free web hosting platform ("Services"). By using our Services, you agree to the terms of this Agreement. If you do not agree, you may not use our Services.

1. Confidential Information

Confidential Information refers to any data or information, whether oral or written, disclosed by Hostium to the Recipient that is designated as confidential or that should reasonably be understood to be confidential given the nature of the information and the circumstances of disclosure. This includes, but is not limited to, personal information, user data, and any other proprietary information stored by Hostium.

2. Data Collection and Storage

Hostium collects and stores user data in a secure database and in Google Sheets. While we implement reasonable security measures to protect your data, Hostium is not liable for any unauthorized access, breaches, or other incidents that may compromise your data. Users are responsible for protecting their own data and are advised to use our Services at their own risk.

3. No Liability for Data Breaches

Hostium disclaims any responsibility or liability for any data breaches, unauthorized access, loss of data, or any other security incidents. By using our Services, you agree that Hostium is not liable for any damages, losses, or claims arising from such events. You acknowledge that you must take appropriate measures to safeguard your data and that Hostium is not responsible for any failure on your part to do so.

4. User Responsibility

You agree that you are responsible for protecting the confidentiality of your own data. The Recipient agrees to use the Confidential Information solely for the purpose of using Hostium's Services. The Recipient agrees not to disclose, share, or otherwise make available the Confidential Information to any third party without the prior written consent of Hostium.

6. Term and Termination

This Agreement will remain in effect as long as the Recipient continues to use Hostium's Services. Hostium reserves the right to terminate this Agreement and your access to the Services at any time, without notice, for any reason. Upon termination, you must cease all use of the Services and return or destroy any Confidential Information in your possession.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles.

8. No Warranty

Hostium makes no representations or warranties of any kind, express or implied, regarding the security, accuracy, or reliability of the Confidential Information. All Services and information are provided "as is," and Hostium disclaims any liability for any issues that may arise from their use.

9. Limitation of Liability

To the fullest extent permitted by law, Hostium shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to this Agreement or the use of the Services, even if Hostium has been advised of the possibility of such damages.

10. Acceptance of Terms

By using our Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to any part of this Agreement, you must immediately stop using the Services.

11. Changes to This Agreement

Hostium reserves the right to modify this Agreement at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the Services after any changes to this Agreement will constitute your acceptance of the changes.
